Law Firm Contacts Steel City Residents for Possible ‘Noxious Odors’ Class Action Suit

A New Jersey law firm that says it has “extensive litigation and trial experience in Pennsylvania” has been mailing letters to residents of Steel City–where a foul odor has drawn recent complaints–as part of its investigation into possibly filing a class action lawsuit against the operators of a Lower Saucon Township landfill.

“To better represent the neighborhood surrounding the landfill, we have partnered with Liddle & Dublin who have successfully handled many air pollution cases, including those involving the emission of noxious odors from landfills,” the April 13 letter from Trenton law firm Kamensky Cohen & Riechelson says.

“Odors which interfere with the use and enjoyment of your home may constitute a nuisance that may entitle you to compensation. Any lawsuit filed by this office would also have the objective of preventing any future emission of noxious odors,” the missive further states.

Although the source of the odor remains unidentified by the state’s Department of Environmental Protection, some Steel City residents believe its source is the IESI landfill, which is located on the other side of a ridge from the neighborhood on Applebutter Road.

Both DEP and township officials continue to investigate the matter.
