A Fountain Hill man who Hellertown Police say flipped his car at the intersection of Easton Road and Northampton Street early on the morning of March 23 has been charged with DUI, texting while driving and other offenses.

In a news release Monday, police said neither Brian Christopher Barron, 24, of the 900 block of School Street, nor anyone else was injured in the 1:03 a.m. crash.

According to court records, after officers arrived at the scene and found his 2010 silver Acura TSX sedan overturned Barron was determined to have an alleged blood alcohol concentration of .12 percent, which is .04 percent higher than the maximum legal limit.

In court records, police said Barron was also allegedly “using an interactive wireless communication device to send, read or write a text-based communication while the vehicle was in motion.”

In addition to texting while driving–which is called Prohibited Text-Based Communications under the PA statute–Barron is charged with DUI-High Rate of Alcohol, DUI and reckless driving.

The two DUI charges are misdemeanors, while the other charges are summary offenses.

As of Monday afternoon a preliminary hearing for Barron had not yet been scheduled, according to county court records.
